Partner Visa Sponsor - New Rules

Australian partner visa applications and prospective marriage visa applications have long required the visa applicant to have a police clearance (penal clearance) to show that they have no criminal records. Good for protecting Australia, but can at times fail to protect a vulnerable Filipina lady newly arrived in Australia, if her spouse, husband, partner or fiance has a criminal record for violent crimes or domestic violence. New rules brought in 18 November 2016 make it mandatory for the Australian sponsor of a partner visa application to (a) get a police clearance to show that he has no significant criminal record for relevant offenses, and (b) to disclose his criminal history to the visa applicant.
